These Terms govern access to Encore, a product of Passionate Pursuit. By creating an account, joining a studio, using a client link, or connecting an app or agent, you agree to the provisions that apply to your use of the service.
1. Agreement, authority, and accounts
You must provide accurate account information, keep credentials secure, and promptly tell Encore if you believe an account or connection has been compromised. You are responsible for activity performed through your account, your studio membership, and the apps or agents you authorize.
If you use Encore for a company, studio, or other organization, you represent that you have authority to accept these Terms for that organization. Team owners are responsible for choosing members and roles. A client participant may use the service only for the project or material shared by the inviting studio.
2. Studios, client data, and privacy
Studios use Encore to collect information from their own clients. As between the studio and Encore, the studio controls the purpose and content of that collection and Encore processes the submitted information on the studio’s behalf to provide the service. The studio is responsible for providing required notices, obtaining any required permissions, and responding to its clients’ data requests. If applicable law requires a separate data processing agreement, contact hello@encorehq.co.
Do not use Encore to collect information you are not permitted to collect. Do not place highly sensitive data—such as government identifiers, financial-account credentials, health records, or children’s data—into a project unless Encore has expressly agreed in writing to support that use and you have a lawful basis to do so.
Studios choose whether client links require verified email or allow guest access. Anyone with a live guest link may be able to access its experience. Project images are currently stored in public-read storage for client rendering, so anyone who obtains a direct image URL may be able to view it. You are responsible for choosing appropriate access settings, revoking links when needed, and avoiding uploads that should never be available by URL.
3. Your content and the service
As between you and Encore, you retain your rights in the projects, questions, responses, images, documents, pages, briefs, templates, and other material you submit or create. You grant Encore a limited, worldwide license to host, copy, process, transmit, display, and modify that content only as needed to operate, secure, support, and maintain the service and to carry out your instructions.
You represent that you have the rights and permissions needed for content you submit and for the way you ask Encore to process or share it. You remain responsible for reviewing deliverables before relying on them or sending them to a client. Encore retains all rights in the service, its software, interface, documentation, and branding.
4. AI features and connected agents
AI processing
Some Encore features send selected project content to Anthropic for image analysis, assistance, page composition, moderation, or synthesis. Depending on the feature, this can include images, client responses, and participant names. AI-generated material can be incomplete, inaccurate, or similar to material generated for others. You must review it before use and must not rely on it as professional legal, medical, financial, or other high-stakes advice.
MCP and agent access
Encore lets you connect compatible third-party apps and agents through an OAuth consent screen. The current connection scopes can allow the app to read studio work and to create or change content on your behalf. A connection acts in the studio selected during consent, and its actions are treated as your authorized instructions.
Review the app, requested scopes, and proposed actions before granting access. Some designated destructive or outward-facing actions require an additional confirmation in Encore, but those safeguards do not replace your supervision. You can disconnect an app in studio settings. The third-party app’s own terms and privacy practices govern its use of information after it receives access.
5. Acceptable use
You may not use Encore, a client link, or a connected agent to:
- Break the law, infringe rights, or facilitate fraud, harassment, or abuse.
- Upload malware or attempt to bypass authentication, permissions, quotas, or safety controls.
- Probe, scan, disrupt, overload, scrape, or reverse engineer the service except where law expressly permits it.
- Access another studio’s data or share a client’s information without authorization.
- Send spam, deceptive messages, or links to people you are not permitted to contact.
- Misrepresent AI-generated material as independently verified fact.
- Use the service to make solely automated decisions that create legal or similarly significant effects for a person.
- Resell or provide access to the service outside the plans and permissions Encore offers.
6. Subscriptions and billing
Polar provides Encore’s hosted checkout, subscription administration, and billing portal. The price, billing interval, trial terms, and renewal details shown at checkout apply to your subscription. You authorize Polar and Encore to charge the payment method associated with the subscription according to those disclosures.
Plan changes, payment-method updates, and cancellation are managed through the billing portal. If a subscription lapses, the studio may become read-only while delivered client work remains available. Deleting the account starts immediate cancellation of an active subscription as part of the account-deletion flow. Any refund required by applicable law will be honored; any additional refund policy must be stated separately at purchase.
7. Service changes, suspension, and termination
Encore may change, add, or remove service features and may use reasonable limits to protect reliability and cost. The service may occasionally be unavailable because of maintenance, provider outages, security events, or other operational reasons.
Encore may suspend or restrict access when reasonably necessary to address a security risk, nonpayment, unlawful use, or a material breach of these Terms. You may stop using Encore at any time. Studio owners can export account data and permanently delete the account from Settings. Provisions that by their nature should survive—such as ownership, disclaimers, liability limits, and accrued payment obligations—survive termination.
8. Disclaimers
To the maximum extent permitted by law, Encore and all outputs are provided “as is” and “as available.” Encore disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Encore does not warrant that AI output is accurate, unique, or suitable for a particular client decision. Nothing in these Terms excludes a warranty that cannot legally be excluded.
9. Limitation of liability
To the maximum extent permitted by law, Encore and Passionate Pursuit will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, business opportunities, or data, arising from the service or these Terms—even if advised that such harm was possible.
To the maximum extent permitted by law, the total aggregate liability of Encore and Passionate Pursuit for all claims arising from the service or these Terms will not exceed the amount you paid for Encore during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot legally be limited.
10. Changes, conflicts, and general terms
Encore may update these Terms as the service changes. The revised Terms will show a new “Last updated” date. If a change is material, Encore will provide notice appropriate to the change. Continued use after the effective date means you accept the revised Terms.
These Terms and any purchase disclosures are the entire agreement about the service. If a provision is unenforceable, the remaining provisions stay in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without Encore’s consent; Encore may assign them in connection with a reorganization, sale, or transfer of the service. If these Terms conflict with a separately signed agreement, the signed agreement controls for that conflict.
